Title: Regulatory Reform Initiative: Rules of Procedure Governing Cases Before the Office of Hearings and Appeals | |
Abstract:
With this deregulatory action, SBA is proposing to revise section 134 to remove an unnecessary regulatory provision and to clarify an existing rule of procedure. SBA is proposing to remove section 134.317 Return of case files, which provides than, upon issuance of the decision, OHA will return the case file to the transmitting office. This rule is unnecessary because it is an internal process that is addressed in OHA’s operating procedures. SBA will propose revising section 134.714 When must the Judge issue his or her decision, to clarify the Judge’s decision is the final agency decision and becomes effective upon issuance. |
