Title: Quality Loss Adjustment Program 
Abstract:

The Additional Supplemental Appropriations for Disaster Relief Act of 2019 authorized the Wildfire and Hurricane Indemnity Program Plus (WHIP+) to help agricultural producers who suffered from production losses due to natural disasters in 2018 and 2019. These disasters include hurricanes, floods, snowstorms, tornadoes, typhoons, volcanic activity and wildfires, and related conditions.  The Further Consolidated Appropriations Act, 2020, added excess moisture and D3 and D4 drought to the list of qualifying natural disasters and expanded the scope of losses suffered due to these events to include quality losses.  This rule will amend the regulations to implement those legislative changes.  The rule will also correct a reference to payment factors in section 760.1511(a)(6). The Further Consolidated Appropriations Act, 2020, also provided that the Secretary will pay sugar beet losses in 2018 and 2019 through cooperative processors.  Assistance for sugar beet losses for members of cooperative processors will be provided through a separate program; therefore, the rule will specify that those sugar beet losses are ineligible for payment under WHIP+.
