Title: Amendments to the Chemical Weapons Convention Regulations and the Export Administration Regulations to Reflect Additions to Schedule 1(A) of the Annex on Chemicals to the Chemical Weapons Convention | |
Abstract:
Consistent with the decisions adopted by the November 2019 Conference of the States Parties of the Organization for the Prohibition of Chemical Weapons (OPCW) to add three chemical families and one individual chemical to Schedule 1A in the Annex on Chemicals to the Chemical Weapons Convention (CWC), BIS is publishing this final rule to amend Supplement No. 1 to part 712 of the Chemical Weapons Convention Regulations (CWCR) (15 CFR parts 710-721) and Supplement No. 1 to part 745 of the Export Administration Regulations (15 CFR parts 730-774) to include these "Schedule 1" chemicals. In addition, this final rule amends the definition of "production" in Section 710.1 of the CWCR to clarify that "production" of a "Schedule 1", "Schedule 2", or "Schedule 3" chemical is understood, for CWCR declaration purposes, to include intermediates, by-products, or waste products that are produced and consumed within a defined chemical manufacturing sequence, where such intermediates, by-products, or waste products are chemically stable and therefore exist for a sufficient time to make isolation from the manufacturing stream possible, but where, under normal or design operating conditions, isolation does not occur. |
