View Rule

This final rule removes the Air Force rule containing internal information about appointment to the Air Force Academy.  The rule was originally published June 26, 1986 (51 FR 23221), and it has not since been updated. This part tells civilian and enlisted personnel (including Air Force Reserve and National Guard) the methods of applying and the requirements and procedures for appointing young men and women to the United States Air Force Academy. Currently 32 CFR part 901 information can be found in AFI 36-2019 and at https://www.academyadmissions.com/admissions/the-application-process/nominations/. This part applies exclusively to organizational entities and members within the Department of Defense.  Where it applies to applicants, who are not yet service members, is internal criteria, related to accessions.  As such, it is subject to the general Military Functions Exemption under the APA. 5 U.S.C. 553(a)(1), as the military alone has the unique expertise to determine. This removal supports a recommendation of the DoD Regulatory Reform Task Force.
