Title: Aquatic Plant Control | |
Abstract:
The existing regulation involves a Corps program for control of noxious aquatic plants in the waters of the United States, including continued research for development of effective and economic control methods. The regulation was published June 3, 1976 (41 FR 22346), pursuant to section 104 of the River and Harbor Act of 1958, as amended by section 104 of the River and Harbor Act of 1962 and by section 302 of the River and Harbor Act of 1965. Since then, however, this law, codified at 33 U.S.C. 610, has been amended several more times, most recently by section 1039(d) of WRRDA 2014 and section 1178(b) of WRDA 2016. The existing regulation is redundant and out of date. This final rule action is largely administrative in nature, by repealing this regulation, the action will provide clarity and reduce confusion to the public. The same content can be found in the Corps’ publication of ER 1130-2-500. The rule does not place a burden on the public, therefore its repeal does not provide a burden reduction or cost savings.
