Title: Categorical Exclusions Under the National Environmental Policy Act | |
Abstract:
The U.S. Army Corps of Engineers' NEPA regulations in 33 CFR 230.9 contain a list of Corps actions that do not require an environmental impact statement or an environmental assessment (unless there is an extraordinary circumstance). This list of NEPA categorical exclusions has not been updated since its inception in 1988. The Corps Civil Works Program is proposing to update its existing list of NEPA categorical exclusions. This proposed modification supports a recommendation of the DoD Regulatory Reform Task Force. In two separate rulemaking actions, the Corps is proposing to update its NEPA implementing procedures applicable to all of the Corps’ Civil Works Programs and to provide specific updates for the Regulatory Program’s implementing procedures for NEPA. |
