The existing regulation provides policies and procedures for seven legislative authorities under which the Secretary of the Army, acting through the Chief of Engineers, is authorized to plan, design and construct certain types of small-scale water resource improvements without a specific project authorization. The projects developed through these Continuing Authorities Program authorities are of limited size, scope and complexity. The existing regulation is redundant and out of date. This final rule action is largely administrative in nature, by repealing this regulation, the action will provide clarity and reduce confusion to the public. The rule does not place a burden on the public, therefore its repeal does not provide a burden reduction or cost savings.
