Title: ●Procedures for Implementing the National Environmental Policy Act for Regulatory Program

In 1988, the U.S. Army Corps of Engineers issued a final rule on procedures for implementing the National Environmental Policy Act (NEPA) for activities that require Department of the Army authorization under sections 9 and 10 of the Rivers and Harbors Act of 1899, section 404 of the Clean Water Act, and section 103 of the Marine Protection, Research, and Sanctuaries Act of 1972, as amended. On July 16, 2020, the Council on Environmental Quality (CEQ) issued a final rule updating its regulations for implementing NEPA (85 FR 43304). The Corps intends to conduct rulemaking to determine whether to amend its NEPA regulations for the Regulatory Program with targeted updates at 33 CFR part 325, appendix B, to conform with the CEQ's amendments to its NEPA regulations and eliminate duplication and redundancy with the CEQ regulation. In two separate rulemaking actions the Corps is proposing to update the NEPA implementing procedures applicable to all of the Corps’ Civil Works Programs and to add new categorical exclusions for use in the Civil Works Programs.
