Abstract:

This proposed rule would revise regulations under, among other statutes, section 504 of the Rehabilitation Act of 1973 and the Emergency Medical Treatment and Labor Act to robustly address unlawful discrimination on the basis of disability in certain vital HHS-funded health and human services programs.

Statement of Need:

In Executive Order 13952, the President directed the Department to issue regulations because of the need to clarify that civil rights protections and medical care standards apply to newborn infants with disabilities whose parents or guardians consent to treatment, and to ensure such laws are robustly enforced. The Executive Order states that some hospitals have or might refuse to provide treatment in compliance with those laws, and the denial of such treatment or discouragement of parents from seeking it devalues the lives of children.
