Title: Radiation Exposure Compensation Act | |
Abstract:
The Radiation Exposure Compensation Act, 42 U.S.C. 2210 note Sec. 6(a), authorizes the Attorney General to establish procedures whereby individuals may submit claims for compensation. The Act sets forth a statute of limitations that bars claims not filed within 22 years of July 10, 2000. RECA Sec. 8(a). The Act further mandates that the Radiation Exposure Compensation Trust Fund terminate, and the duties of the Attorney General cease 22 years after July 10, 2000. RECA Secs. 3(d), 6(g). Among other things, current regulations published at 28 CFR part 79 do not take into account or set forth procedures for the receipt or processing of claims filed near or at the termination of the program. Therefore, the Department of Justice is considering whether to revise procedures for filing claims on or near to the statute of limitations under RECA. |
