Title: Custody Review Authority of Immigration Judges Over Aliens Transferred From Expedited Removal Upon Finding Credible Fear
Abstract:

The Department of Justice (DOJ) is proposing to amend the regulations governing expedited removal to specify that immigration judges lack the authority to redetermine custody conditions for aliens transferred to proceedings before an immigration judge from expedited removal after a finding of credible fear. The rulemaking also would clarify which aliens are subject to such provisions.
