Title: ●Criminal Negligence Standard for State Clean Water Act 402 and 404 Programs | |
Abstract:
Section 402 of the Clean Water Act (CWA) allows states and tribes to be approved to administer the National Pollutant Discharge Elimination System (NPDES) permit program. State and tribes can also assume the CWA program for dredge and fill activities under section 404(g). EPA is proposing regulations to clarify the criminal intent standard applicable to state and tribal CWA 402 and 404(g) programs, respectively. |
