Title: Implementing Certain Provisions of the Transparency Improvements and Compensation to Keep Every Ticket-Holder Safe Act of 2018 
Abstract:

This final rule would implement a provision of the "Transparency Improvements and Compensation to Keep Every Ticket-holder Safe Act of 2018 (TICKETS Act)", which is under section 425 of the FAA Reauthorization Act of 2018. Section (e) of the TICKETS Act requires the Department to issue a final rule that revises 14 CFR part 250, the Department's oversales rule, to clarify that the regulation does not limit the maximum amount of Denied Boarding Compensation (DBC) that a carrier may provide to a passenger denied boarding involuntarily. This action would also codify a self-effectuating requirement of the TICKETS Act, under section 425(b)-(d), that prohibits airlines from denying a revenue passenger traveling on a confirm reservation permission to board after the boarding pass is collected or scanned at the gate, or from involuntarily removing that passenger from the aircraft after the passenger has already boarded, subject to safety and security exceptions. Further, In accordance with existing regulations, this final rule would raise the liability limits for denied boarding compensation that carriers may impose, and the minimum liability limit air carriers may impose for mishandled baggage in domestic air transportation for inflation.
