Title: Streamlining Reporting Requirements for Lead-Based Paint Hazards in Project-Based Assistance Housing and Tenant-Based Rental Assistance Housing (FR-6027) | |
Abstract:
This interim final rule updates and streamlines HUD’s lead safe housing regulations. Specifically, the rule amends the regulatory language in 24 CFR part 35, subparts H and M, which pertain to Project-Based Assistance and Tenant-Based Rental Assistance, respectively. The rule also makes one minor technical correction in subpart L, which pertains to Public Housing. In 2017, HUD published a final rule, amending its lead-based paint regulations to reduce blood lead levels in children under age six (6) who reside in federally-owned or -assisted pre-1978 housing. After publication of the final rule, HUD received feedback recommending that the rule’s reporting requirements, specifically those for residential properties receiving project-based assistance and housing occupied by families receiving tenant-based rental assistance, should be streamlined to ensure that the reporting process conformed to best practices and reflected existing relationships among the interested parties. Through this interim final rule, HUD streamlines the reporting process to reflect best or existing practices, and to reduce the burden on owners. This rule also updates the definition of target housing in subpart B to reflect the slight expansion of the scope of that term by the Consolidated Appropriations Act, 2017 (Pub. L. 115-31, approved May 5, 2017). The Act amended the definition of target housing, which generally included most pre-1978 housing, to include the small number of pre-1978 zero-bedroom dwellings in which a child under age 6 resides or is expected to reside. These dwellings had previously been exempted from the definition of target housing and, thus, from the regulations covering lead safety in federally-owned or -assisted pre-1978 housing. This rule also harmonizes the dust lead hazard standards and interim control clearance levels in subpart R with EPA’s 2019 dust lead hazard standards final rule (84 FR 32632; July 9, 2019). |
