Title: Fees for the Representation of Claimants Before the Department of Veterans Affairs | |
Abstract:
The Department of Veterans Affairs (VA) intends to amend existing regulations in part 14 of title 38 of the Code of Federal Regulations relating to the charging of fees for representation of VA claimants by agents and attorneys and the direct payment of fees by VA to attorneys from claimants’ benefits. These amendments will update the system with regard to the process of determining the amount of the fee and payment procedures for attorneys and agents who are discharged by the claimant or withdraw from representation before the award of benefits has been made, address recent decisions by the Court of Appeals for Veterans Claims relating to fees, and clarify and improve the existing regulations. |
