Title: Amendments to the Regulations at 29 CFR Part 1602 to Provide for a Pay Survey | |
Abstract:
The EEOC is considering initiating a rulemaking (with a Paperwork Reduction Act component) that may include a new reporting requirement by which employers would submit pay data or related information as reasonable, necessary, or appropriate for the enforcement of title VII of the Civil Rights Act of 1964 and the Equal Pay Act. See 42 U.S.C. 2000e-7(c). The EEOC would seek public comment regarding the potential benefits to its enforcement of anti-discrimination laws, appropriate methods of collecting pay data, and burdens on respondents to collect and report pay data or related information under proposed alternatives as well as other alternatives suggested by commenters. |

Additional Information: The EEOC commissioned a study from the National Academy of Science (NAS) of the potential benefits and burdens of collecting pay data from employers. The EEOC intends to revisit the recommendations raised by the NAS in its 2012 report, Collecting Compensation Data from Employers, in assessing any pay survey. These issues include, for example, preparing a comprehensive plan for use of compensation data, ensuring that the data collection will enhance the EEOC's enforcement efforts, and assessing the EEOC's capacity for the collection and analysis of the data. | |
