Title: Clean Water Act Section 401: Water Quality Certification for U.S. Army Corps of Engineers Projects | |
Abstract:
The U.S. Army Corps of Engineers (Corps) ensures compliance with the relevant statutes governing Army Civil Works operations and maintenance projects involving the discharge of dredged or fill material into waters of the U.S. The Clean Water Act requires the Corps to seek state water quality certification for discharges of dredged or fill material into waters of the U.S. associated with Corps projects. The Corps is planning to propose revisions to appropriate sections of 33 CFR parts 335 to 338 for Corps projects to ensure consistency with EPA’s finalized section 401 water quality certification regulation. The Corps will reevaluate the path forward on this rulemaking action pending future actions by EPA. |
