Title: Commercial Item Determinations (DFARS Case 2020-D033) 
Abstract:

DoD is issuing a final rule to amend the Defense Federal Acquisition Regulation Supplement (DFARS) to implement section 848 of the National Defense Authorization Act for Fiscal year 2018 (Pub. L. 114-328). Section 848 modifies 10 U.S.C. 2380(b) to provide that a contract for an item using Federal Acquisition Regulation part 12 procedures shall serve as a commercial item determination, with some exceptions.
