This final rule removes the DoD regulation which contains the unnecessary restatement of internal policies and procedures for admissions to the School of Medicine, Uniformed Services University of the Health Sciences. The rule is outdated, contains internal guidance, reiterates statutory law (10 U.S.C. 2112, et seq.), and is otherwise subject to the military function exemption to rulemaking. It has been determined that publication of this CFR part removal for public comment is impracticable, unnecessary, and contrary to public interest since it is based on removing DoD internal policies and procedures that are publicly available in DoD Instruction 5105.45, "Uniformed Services University of the Health Sciences (USU),” most recently updated on May 30, 2019, and available at https://www.esd.whs.mil/Portals/54/Documents/DD/issuances/dodi/510545p.pdf?ver=2019-05-30-074128-497.
