Title: ●Modification of Limitations on Redesignation by the Medicare Geographic Classification Review Board (CMS-1762)

This rule amends regulations to allow hospitals with a rural redesignation under section 1886(d)(8)(E) to reclassify under the MGCRB using the rural reclassified area as the geographic area in which the hospital is located. These regulatory changes implement the decision in Bates Cnty. Mem'l Hosp.(Bates) v. Azar , Civil Action No. 19-1767 (TJK) (D.D.C. May. 14, 2020), effective with reclassifications beginning with fiscal year (FY) 2023.
