Abstract:

On August 26, 2019, the Department of Justice (Department) published an interim final rule, subsequently finalized on November 3, 2020, titled Organization of the Executive Office for Immigration Review (RIN 1125-AA85) to amend the EOIR regulations regarding its internal structure and organization, clarify the responsibilities of its components, and synchronize EOIR’s organizational regulations with the Department's broader organizational regulations. That regulatory change was necessary due to the establishment of a new official component within EOIR in 2017, the Office of Policy, whose functions and responsibilities were not delineated in EOIR’s regulations. With this RIN, the Department is planning to modify or rescind the provision regarding the EOIR Director’s authority, as established in 2019, over certain cases falling within EOIR’s purview.
