Title: ●American Rescue Plan Emergency Assistance to Non-Public Schools (ARP EANS) Program  
Abstract:

The American Rescue Plan Act of 2021 (ARP Act), provides $2.75 billion for awards to Governors under the ARP EANS program to provide services or assistance to eligible non-public elementary and secondary schools to address the impact the Coronavirus Disease 2019 (COVID-19) has had, and continues to have, on non-public school students and teachers in each State. The ARP EANS Program requires that a State providing services or assistance under this program must provide them to eligible non-public schools that enroll "a significant percentage of low-income students" and "schools most impacted by COVID-19."  These terms were not defined, and they were not included, in previous COVID-19 relief packages.  To support the effective implementation of this new provision, the Department intends to establish a rule to clarify the meaning of the terms:"significant percentage of low-income students" and "most impacted by the qualifying emergency."
