Abstract:
On December 23, 2020, EPA published in the Federal Register an immediately effective procedural rule establishing processes related to the development and consideration of benefit-cost analysis (BCA) that EPA must undertake when promulgating proposed and final regulations under the Clean Air Act (CAA). In response to the January 20, 2021 Executive order on Protecting Public Health and the Environment and Restoring Science to Tackle the Climate Crisis (EO 13990) which stated that EPA "shall consider publishing for notice and comment a proposed rule suspending, revising, or rescinding" the rule, OAR is undertaking this action. |
