Title: Production or Disclosure of Information 
Abstract:

The Freedom of Information Act (FOIA) was amended in June 2016, by the FOIA Improvement Act of 2016. The FOIA amendments required agencies to review and update their FOIA regulations in accordance with the provisions of the Act. The Act requires a wide range of modifications including contraction of the Exemption 5 deliberative process privilege, codification of the foreseeable harm standard, limitations on an agency’s ability to apply fees where it fails to meet statutory time limits, and an extended period in which to file an appeal of the denial of a request, among others. The Federal Mediation and Conciliation Service drafted a total revision to its FOIA regulations to address the amendments.
