Title: Gaming Ordinance Submission Requirements | |
Abstract:
The National Indian Gaming Commission (NIGC or Commission) is considering updating its tribal gaming ordinance regulations. Under 25 CFR 522.2(d), tribes must provide various gaming ordinance submission requirements for the Chairman’s review and approval or disapproval. This rulemaking considers addressing a situation where tribes may be unable to meet certain gaming ordinance submission requirements because such documents do not yet exist. For example, tribal gaming regulations are a submission requirement that sometimes may only exist after they are promulgated by the tribe’s gaming regulatory authority (TGRA) which is established by the ordinance under the Chairman’s consideration. In particular, a tribe that submits their first gaming ordinance may not be able to fulfill all gaming ordinance submission requirements because their gaming ordinance has not yet established a gaming commission to promulgate tribal gaming regulations or enter into a compact with the State. The Commission will also perform a thorough review of the regulation for needed updates. |
