Title: Status of Pending Disability Application After Death of Applicant
Abstract:

The U.S. Office of Personnel Management (OPM) is proposing to amend 5 CFR 831.112 and 5 CFR 843.102 to clarify that when an employee dies, the claim of entitlement to an annuity payable under 5 U.S.C. 8337 and 8451 (provisions for disability under the Civil Service Retirement System and Federal Employees’ Retirement System) does not die with them. An application for disability retirement filed before death will be adjudicated by OPM.
