Title: ●Past Performance Ratings for Small Business Joint Venture Members and Small Business First-Tier Subcontractors 
Abstract:

This rule implements section 868 of the NDAA for FY2021, Pub. L. 116-283, which provides methods for small businesses to seek past-performance ratings for work performed as part of a joint venture or as a first-tier subcontractor. For joint venture members, the small business may elect to use the past performance of the joint venture when submitting an offer on a prime contract. For first-tier subcontractors, the small business may seek a past-performance record from the prime contractor before electing to use the record for its offer on a prime contract.
