Abstract:
To promote the unified development and regulation of the Tennessee River System, Congress directed TVA to approve obstructions across, along, or in the river system under Section 26a of the TVA Act. TVA also owns, as agent for the United States, much of the shoreland and inundated land along and under its reservoir system. In the Water Infrastructure Improvements for the Nation Act of 2016, Congress established that TVA may establish health, safety, and environmental standards for floating cabins. There are approximately 2,200 floating cabins on the Tennessee River System. TVA evaluated six alternatives to the management of floating cabins in an Environmental Impact Statement. These rule amendments establish health, safety, and environmental standards for floating cabins, including standards for electrical safety, flotation, mooring, and wastewater discharge. The amendments also create permitting standards for the management of the floating cabin program. Floating cabin owners will have until 2024 to comply with the new standards and apply for a TVA Section 26a permit in order to remain on the Tennessee River System. Some floating cabin owners will incur costs to modify their floating cabin to meet the new standards; however, most are one-time investments that will likely increase the resale value of the floating cabin. The result of the rule will be positive impacts to the environment, natural resources, and public health and safety due to consistent standards and establishment of a permitting program for these 2,200 structures. |
