Abstract:
The U.S. Army Corps of Engineers (Corps) would remove this regulation as its administrative procedures are either outdated, or their subject matter is now covered elsewhere, or the regulations that they supplement have themselves been superseded or recommended for repeal. The current regulation consists of 19 administrative provisions covering interactions with the public in the implementation of a wide variety of statutes and regulatory processes, including: public participation in meetings of the Mississippi River Commission (from 1977); the Corps' handling of applications for drilling off the coast of California (from 1978); processing Federal Power Commission (now FERC) applications for hydropower licenses at Corps facilities (from 1968 and 1975); coordination with DOE Power Marketing Administrations on hydropower generation at Corps reservoirs (from 1978); policy to not expend funds for removal of wrecks shoreward of harbor lines; handling of mining petitions by the California Debris Commission (abolished in 1986) and processing of violations of laws concerning the protection navigable waters (from 1968, 1971, and 1988); handling applications for temporary closure of waterways and for prescribing navigation regulations (from 1968, 1986, and 1987); interaction with non-Federal interests on the construction and completion of Corps-constructed flood control projects and on the use of reservoir areas for recreation; processing of new regulations for non-Federal operation and maintenance of Corps-constructed flood control projects; indicating locations of cables and pipelines on nautical charts (from 1986); guidance on public access to navigation facilities; policy on release of commercial statistics so that confidential shipping data not be disclosed; policy and practice on coordination with Coast Guard on navigation aids and charts (from 1978); policy and procedures on investigations and tests at Corps laboratory installations for other government agencies and private organizations (from 1979); and, reimbursement for work by non-Federal public body for construction of part of an authorized Federal project under Section 215 of the Flood Control Act of 1968 (from 1977). |
