Title: Modification of Small Purchase Threshold Exceptions (DFARS Case 2021-D010) 
Abstract:

DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement to implement section 817 of the National Defense Authorization Act for Fiscal Year 2021. Section 817 amends 10 U.S.C. 2533a(h) by: (1) Decreasing the threshold applicable for exemption for small purchases (Berry Amendment) by removing the phrase "simplified acquisition threshold" and replacing it with "$150,000"; (2) Prohibiting the division of procurements into smaller amounts in order to qualify for the $150,000 exception; and (3) Permitting the threshold to be adjusted on October 1 of each year divisible by five based on changes in the Consumer Price Index.
