Title: Endangered and Threatened Wildlife and Plants; Threatened Species Status With Section 4(d) Rule for Emperor Penguin  
Abstract:

This final rule will make a determination on our proposal to list the emperor penguin (Aptenodytes forsteri), a flightless bird species from Antarctica, as a threatened species with a rule issued under section 4(d) of the Endangered Species Act of 1973, as amended (Act). If FWS finalizes this rule as proposed, it would add this species to the List of Endangered and Threatened Wildlife and extend the Act’s protections to the species.
