Abstract:

The Department proposes revising the regulations consistent with Matter of E-F-H-L- , 26 I&N Dec. 319 (BIA 2014), to require immigration judges to first conduct an evidentiary hearing before denying an application for asylum, withholding of removal, or protection under the Convention Against Torture.
