Abstract:
The Department intends to update the definition of prostitution contained in 22 CFR 40.24, consistent with the modern understanding of prostitution. The definition currently in the regulation was crafted in 1959 and has not been updated to match current definitions of prostitution, such as the Model State Criminal Provisions promulgated pursuant to section 225 of the Trafficking Victims Protection Reauthorization Act of 2008 (TVPRA 2008), which provides, "prostitution" means "a sexual act or contact with another person in return for giving or receiving a fee or a thing of value.” |
