Title: Energy Conservation Program: Product Classes for Residential Dishwashers, Residential Clothes Washers, and Consumer Clothes Dryers | |
Abstract:
On October 30, 2020 and December 16, 2020, the Department of Energy ("DOE") published two final rules that established product classes for residential dishwashers with a cycle time for the normal cycle of 60 minutes or less, top-loading residential clothes washers and consumer clothes dryers with a cycle time of less than 30 minutes, and front-loading residential clothes washers with a cycle time of less than 45 minutes. 85 FR 68723; 85 FR 81359. The final rules amended the energy conservation standards for those products without considering whether the relevant statutory criteria for amending standards were met as required by the Energy Policy and Conservation Act (EPCA), as amended. In this rulemaking, DOE proposes to revoke the two earlier rules that improperly promulgated standards and reinstate the prior product classes and applicable standards for these covered products. This review is also consistent with the direction provided in Executive Order 13990 of January 20, 2021, "Protecting Public Health and the Environment and Restoring Science to Tackle the Climate Crisis." 86 FR 7037 (January 25, 2021). While Executive Order 13990 triggered DOE’s re-evaluation, DOE is relying on the analysis presented in the proposal, based upon EPCA, to re-examine the October and December 2020 Final Rules. |
