DOT/FMCSA RIN: 2126-AC39 Publication ID: Fall 2021
Title: Passenger and Hazardous Materials Vehicles and Railroad Highway Grade Crossings
Abstract:

FMCSA proposes to amend the Federal Motor Carrier Regulations related to driving a commercial motor vehicle (CMV) at a highway-rail grade crossing. The current regulations, divided into three sections, would be simplified and consolidated into one section. The rule would eliminate the mandatory stop at grade crossings currently required for drivers of certain CMVs and prohibit drivers of all CMVs from driving onto a grade crossing without exercising due caution (including slowing down, as necessary) upon approaching the crossing to ascertain safe clearance. This rule would also make conforming amendments elsewhere in the Code of Federal Regulations (CFR).
