This rule follows an interim final rule published on July 31, 2012, which provided the regulatory framework to implement the Continuum of Care Program, established by the Homeless Emergency Assistance and Rapid Transition to Housing Act of 2009 (HEARTH Act), enacted into law on May 20, 2009. This rule would finalize the interim final rule to update regulations governing the Continuum of Care program, and Continuum of Care planning process. HUD recognizes that recipients have gained valuable experience implementing the 2012 interim final rule, therefore, prior to finalizing this rule HUD plans to solicit public comments on the 2012 interim final rule. HUD also issued an interim final rule on June 14, 2016 which allows individuals and families to choose housing outside of a Continuum of Care’s geographic area, subject to certain conditions. 81 FR 38581. In addition, on July 26, 2016, HUD published a request for comments regarding whether HUD should make changes to the formula. 81 FR 48366. HUD will consider all of these comments before issuing a final rule that addresses both the 2012 and 2016 interim final rules.
