The Commission received correspondence from the Juvenile Products Manufacturers Association (JPMA), dated May 9, 2012, requesting that the Commission initiate rulemaking to distinguish and regulate "hazardous pillow-like" crib bumpers from "non-hazardous traditional" crib bumpers under sections 7 and 9 of the Consumer Product Safety Act (CPSA). The Commission granted the petition. The Commission issued a request for information (RFI) in February 2016, seeking information regarding the safety benefits of crib bumpers, whether safety hazards are associated with crib bumpers, existing safety standards that apply to crib bumpers, and potential performance requirements, testing, and other standards that may reduce the risk of injury, if any, associated with crib bumpers. CPSC staff is working with ASTM to improve the voluntary standard for infant bedding. In September 2019, staff delivered to the Commission an NPRM briefing package for a proposed rule under section 104 of the Consumer Product Safety Improvement Act of 2008 (CPSIA). In April 2020, the Commission issued a proposed rule. Staff is working on a briefing package for a final rule.
