SBA RIN: 3245-AH87 Publication ID: Fall 2021
Title: ●Affiliation and the Business Loan Programs
Abstract:

SBA will publish an advance notice of proposed rulemaking to solicit comments from the public and industry regarding SBA’s affiliation rules. Under SBA’s affiliation rules for financial assistance programs, SBA may find a loan applicant to be affiliated with another concern. The concepts of affiliation need to be clear and easy to apply for borrowers, lenders, and other industry associates to ensure program compliance. SBA is seeking comments on the potential use of technology as part of the solution for the Business Loan Programs. Contractual controls and economic dependence are issues that impact certain agriculture industries and franchise relationships. SBA plans to review comments received and, as appropriate, amend the regulations for the affiliation principles applicable to SBA financial assistance programs.
