Abstract:
Executive Order 13891, titled "Promoting the Rule of Law Through Improved Agency Guidance Documents," which required Federal agencies to finalize regulations, or amend existing regulations as necessary, to set forth processes and procedures for issuing guidance documents, was revoked by President Biden on January 20, 2021, via Executive Order 13992, titled "Revocation of Certain Executive Orders Concerning Federal Regulation." Executive Order 13992 published in the Federal Register on January 25, 2021 (86 FR 7049-7050). By issuing this final rule, the Department of Defense (DoD) is responding to the repeal of Executive Order 13891. This final rule will amend the DoD policies and processes governing the issuance and use of guidance documents. |
