Title: Migratory Bird Management; Revision of General Exceptions to Permit Requirements 
Abstract:

This proposed rulemaking will seek public comments on amending FWS regulations relating to general exceptions to the permit requirements of the Migratory Bird Treaty Act by updating the existing exceptions for law enforcement, disease response, licensed veterinarians, and birds inside of buildings or structures. Topics include an exception for routine duties of natural resource agencies, further codifying the Service’s "good Samaritan” regulation pertaining to persons who provide help to birds in need, and setting standards and processes that FWS would follow to determine if a requesting entity could qualify for an exception from migratory bird permit requirements. Currently, FWS's general exceptions to permit requirement regulations include State game departments, municipal game farms or parks, public museums, public zoological parks, accredited institutional members of the Association of Zoos and Aquariums (AZA), and public scientific or educational institutions. The FWS has received requests from zoological associations not affiliated with AZA requesting that they, too, be considered for the permit exception. This proposed rule will also include provisions from former RIN 1018-BD77 to clarify when a permit is and is not needed under the Airborne Hunting Act.
