Abstract:
This rule is part of an iterative rulemaking process that begins by proposing to add new definitions to 6 CFR part 37 (REAL ID regulations) for mobile driver’s licenses and mobile identification cards, collectively referred to as mDLs, and to allow for federal acceptance of mDLs for official purposes under certain circumstances. The rule would require that to be accepted after full enforcement of the REAL ID regulations, a mDL must be issued by a State that obtains a waiver of those requirements. This waiver would be based on a determination by the Department of Homeland Security (DHS) that the State is in full compliance with standards established by DHS for mDLs. Once multiple industry technical standards are finalized and published, DHS would issue requirements for REAL ID-compliant mDLs. This rulemaking, therefore, would be the first step in a multi-phased rulemaking to enable Federal agencies, at their discretion, to continue accepting mDLs during the period between full enforcement of REAL ID requirements and issuance of comprehensive regulatory requirements for mDLs. |
