Title: Implementing a Known Employer Program for Certain Employment-Based Nonimmigrant and Immigrant Visa Classification | |
Abstract:
The Department of Homeland Security (DHS) will propose regulations to amend the filing process for certain employers seeking to hire certain workers through employment-based visa categories. Specifically, eligible employers may be able to request that USCIS pre-adjudicate certain eligibility requirements of petitions relating to certain employment-based nonimmigrant and immigrant visa classifications. This change would promote simplicity and efficiency in the benefit application process for employers, while allowing USCIS to further protect benefit integrity and ensure consistency with respect to adjudications. In addition, this initiative would reduce paperwork for all parties. This NPRM would propose to codify the USCIS’ Known Employer Pilot Program, which was in effect from March 3, 2016 and through December 31, 2020. |
