DOT/NHTSA RIN: 2127-AL62 Publication ID: Spring 2022
Title: 49 CFR Part 512 Confidential Business Information
Abstract:

This rulemaking would establish a procedure that NHTSA would only process requests for confidential treatment when it receives a FOIA request for the data, when a review and response are needed to ensure that requests are properly submitted, or when a review and response are in the public interest. The rule also would modify the existing requirements for submitting requests for confidential treatment in response to recent changes to the standard for withholding confidential materials under FOIA in response to the Supreme Court’s decision in Food Mktg. Inst. v. Argus Leader Media. The rule would also provide a means for submitters to make their requests to NHTSA electronically.
