Title: Child Nutrition Program Integrity | |
Abstract:
FNS is merging provisions from three proposed rules - the Child and Adult Care Food Program: Amendments Related to the Healthy, Hunger-Free Kids Act of 2010 rule (0584-AE12); most of the monitoring provisions within the Simplifying Meal Service and Monitoring Requirements in the National School Lunch and School Breakfasts rule (0584-AE67), and the CN Program Integrity Rule (0584-AE08). The merged provisions will be incorporated into a single final rule to be published in Spring 2023 as the CN Program Integrity Final Rule (0584-AE08). Of note, FNS will no longer be pursuing rulemaking as a separate action for 0584-AE12 or 0584-AE67. The provisions that will be merged from the Simplifying Meal Service and Monitoring Requirements in the National School Lunch and School Breakfasts rule (0584-AE67) and the Child and Adult Care Food Program: Amendments Related to the Healthy, Hunger-Free Kids Act of 2010 rule (0584-AE12) reduce administrative burden for State agencies and School Food Authorities (SFAs), maintain accountability and integrity in the school meal programs, and codifies several provisions of the Healthy, Hunger-Free Kids Act of 2010 (Pub. L. 111-296) that affect management of the Child and Adult Care Food Program. The Child Nutrition Program Integrity rule (0584-AE08) codifies three provisions of the Healthy, Hunger-Free Kids Act of 2010 to include establishing criteria for imposing fines against schools, SFAs, or State agencies that fail to correct severe mismanagement of the programs; establishing procedures for the termination and disqualification of organizations participating in the Summer Food Service Program (SFSP); and requiring that any school, institution, service institution, facility, or individual that has been terminated from any program authorized under the Richard B. Russell National School Lunch Act or the Child Nutrition Act of 1966, and appears on either the SFSP or the CACFP’s disqualified list, may not be approved to participate in or administer any other programs authorized under those two Acts. |
