Title: Administrative Protective Order, Service, and other Procedures in Antidumping and Countervailing Duty Proceedings 
Abstract:

Pursuant to its authority under title VII of the Tariff Act of 1930, as amended (the Act), the Department of Commerce (Commerce) intends to propose amending its regulations (part 351) governing procedures related to administrative protective order (APO) and service of documents submitted in antidumping (AD) and countervailing duty (CVD) proceedings. This proposed rulemaking will consider making permanent changes to Commerce’s APO and service procedures from the Temporary Rule Modifying AD/CVD Service Requirements Due to COVID-19 (85 FR 41363). The proposed rulemaking will also address potential clarifications and corrections to other procedural aspects of part 351, including updates to the scope, circumvention, and covered merchandise referral regulations. Lastly, Commerce proposes to delete from its regulations two provisions that have been invalidated by the United States Court of Appeals for the Federal Circuit.
