View Rule

Based on the Pacific Fishery Management Council's (Council) recommendation, this rule would implement Amendment 6 to the Fishery Management Plan for U.S. West Coast Fisheries for Highly Migratory Species (HMS FMP) through regulations at 50 CFR 660 subpart K for the authorization and management of deep-set buoy gear for targeting swordfish and other marketable HMS. At present, only two commercial gear types, drift gillnet and harpoon, are authorized to harvest the stock of swordfish in federal waters off the U.S. West Coast.  In implementing Amendment 6, this action would propose operational specifications for deep-set buoy gear and criteria for permitting its use in federal waters off the U.S. West Coast.  The purpose of these proposed regulations implementing Amendment 6 to the HMS FMP is to provide additional opportunities to fish for swordfish and other HMS in federal waters off the U.S. West Coast in the interest of achieving optimum yield while minimizing to the extent practicable interactions with protected species and potential conflicts with other gear types.
