The U.S. Army Corps of Engineers (Corps) proposes to revise and update this regulation, which governs procedures for executing the Corps' functions under the authorities of the Federal Power Act. The regulation is out of date based on the current Memorandum of Understanding with the Federal Energy Regulatory Commission and requires conforming edits to update, in particular regarding roles and responsibilities distinguishing between Corps and FERC jurisdiction with respect to non-Federal hydroeletric projects, revision to provide for current Corps methods to cover costs related to FERC licensing, and other administrative edits such as updating citations to Corps regulations and other Federal agency regulations.
