Title: Implementation of Section 235 of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008; Treatment of Unaccompanied Children 
Abstract:

The Department of Justice (Department), Executive Office for Immigration Review (EOIR), is planning to propose to amend its regulations to implement section 235 of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008, which provides new provisions for unaccompanied children in asylum and immigration proceedings. EOIR is proposing to amend its regulations to reflect that the U.S. Citizenship and Immigration Services has initial jurisdiction over any asylum application filed by an unaccompanied child. The Department also plans to propose to add new special procedures for unaccompanied children in interviews before asylum officers and in proceedings before immigration judges, and revisions governing the relief of voluntary departure for unaccompanied children in removal proceedings.
