Title: National Emission Standards for Hazardous Air Pollutants: Site Remediation 
Abstract:

This action regards certain exemptions included in the Site Remediation National Emission Standards for Hazardous Air Pollutants (NESHAP). The EPA promulgated the Site Remediation NESHAP on October 8, 2003. The Sierra Club filed a petition for reconsideration challenging the exemptions for federally overseen cleanups under CERCLA and RCRA in the final rule. The EPA published a proposed notice of reconsideration on that issue in the Federal Register on May 13, 2016 (81 FR 29821). In a separate action, the EPA published the proposed Residual Risk and Technology Review (RTR) for Site Remediation on September 3, 2019 (84 FR 46138), and used the opportunity to request additional comment on the exemptions and related issues. EPA indicated it would take the comments into consideration in this action regarding the exemptions. EPA published the final RTR on July 10, 2020 (85 FR 41680). The EPA intends to take final action by December 30, 2022.
