Title: Prevention of Significant Deterioration (PSD) and Nonattainment New Source Review (NNSR): Reconsideration of Fugitive Emissions Rule 
Abstract: The EPA is reconsidering the final rule titled, "Prevention of Significant Deterioration (PSD) and Nonattainment New Source Review (NSR): Reconsideration of Inclusion of Fugitive Emissions; Reconsideration." (73 FR 77882; December 19, 2008) This rulemaking would address which types of stationary sources of air pollution have to include fugitive emissions in determining whether a project is a major modification subject to the major New Source Review air permitting regulations. In 2009, the EPA granted reconsideration on a petition to reconsider the 2008 rule and subsequently issues an administrative stay of the 2008 rule. On March 30, 2011, the EPA issued an interim rule that stayed the Fugitive Emissions Rule by reverting the text of the affected sections of the Code of Federal Regulations back to the prior rule language. (76 FR 17548) This stay will remain in effect until the EPA completes its reconsideration and undertakes any associated rulemaking.
